Curb Ramp LLC, its subsidiaries, and affiliates (collectively, “Curb Ramp,” “we,” “our,” or “us”) are pleased to offer you our products and online services. These Terms of Use form an agreement between Curb Ramp and you and set forth the terms and conditions upon which we make our products and services available to you. You must be 18 or older to use the products and/or online services.
By using our products and/or services, you accept these Terms of Use. If you do not accept these Terms, do not use our products and/or services.
1) Important Notices
These Terms contain provisions that limit your legal rights, including an arbitration provision, waivers of class actions and jury trials, and limitations on Curb Ramp’s liability.
2) Dispute Resolution & Arbitration (No Class Actions)
You and Curb Ramp agree that any and all disputes or claims that have arisen or may arise between you and Curb Ramp in connection with the online services—including any products offered or sold on the online services and your use of the online services—shall be resolved exclusively through confidential, final, and binding arbitration, except that either party may file suit in court to seek to enjoin infringement, misappropriation, or misuse of its intellectual property rights.

Forum & Rules: Arbitration will be conducted by the American Arbitration Association (AAA) under its rules and procedures (including the AAA’s Supplementary Procedures for Consumer-Related Disputes, as applicable), as modified by this agreement to arbitrate. See the AAA’s rules and filing forms at www.adr.org.

Location: The arbitration shall be held in the county where you reside or at another mutually agreed location.

Small Claims Option: If the value of the relief sought is $10,000 or less, either you or Curb Ramp may elect to have the arbitration conducted by telephone or based solely on written submissions, which election shall be binding on the other party, subject to the arbitrator’s discretion to require an in-person hearing if circumstances warrant. Attendance at an in-person hearing may be made by telephone, unless the arbitrator requires otherwise.

Applicable Law: The arbitrator will decide the substance of all claims in accordance with the laws of the State of Georgia, including recognized principles of equity, and will honor all claims of privilege recognized by law.

Individual Basis Only: You and Curb Ramp agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any class, representative, or consolidated action or proceeding. Unless both you and Curb Ramp agree otherwise, the arbitrator may not consolidate or join more than one person’s or party’s claims and may not preside over any form of a consolidated, representative, or class proceeding.

Relief: The arbitrator may award relief (including monetary, injunctive, and declaratory relief) only in favor of the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim(s). Any relief awarded cannot affect any other person or party.

Confidential & Final: The arbitrator’s award shall be confidential, final, and binding, and judgment on the award may be entered in any court having jurisdiction.

Fees: Payment of filing, administration, and arbitrator fees will be governed by the AAA’s rules.
3) Limitations of Liability
In no event shall Curb Ramp be liable for any direct, indirect, punitive, incidental, special, or consequential damages to property or life, arising out of or connected with the use or misuse of our products or services. We assume no liability, expressed or implied, as to the architecture, engineering, or workmanship of any project.
Please consult your local rules and regulations prior to installing. Curb Ramp assumes no liability for violations of law or regulations.
4) Responsibility for Local Compliance
Curb Ramp LLC provides curb ramps for general accessibility purposes. It is the customer’s responsibility to ensure that installation and use of our curb ramps comply with all local, city, and neighborhood rules, regulations, and ordinances pertaining to curb ramps or accessibility features.
Curb Ramp LLC disclaims any liability for issues or consequences that may arise from use of our curb ramps in areas where specific rules or restrictions are in place. Customers are advised to conduct thorough research and seek necessary approvals from relevant authorities before installation.

By purchasing and using our curb ramps, customers acknowledge and accept responsibility for ensuring compliance with all applicable laws and regulations in their respective areas. Curb Ramp LLC shall not be liable for any legal disputes, fines, penalties, or other consequences resulting from non-compliance.
5) Choice of Law
These Terms of Use are governed by and construed in accordance with the laws of the State of Georgia, without giving effect to any principles of conflicts of laws. A printed version of these Terms of Use shall be admissible in judicial, administrative, or arbitration proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
6) Sourcing & Product Naming
To ensure timely order fulfillment, we may source ramps from independent manufacturers, suppliers, or resellers if our inventory runs low. While names and descriptions may vary for identification purposes on our website, we guarantee consistent quality.
7) Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of our products and/or services after changes are posted constitutes acceptance of the updated Terms.
